    To All Administrative Law Judges:

    This is a follow-up to my message below regarding the provision in Article 20, Section 2C. The Agency and IFPTE have mutually agreed not to enforce the 2 year continuous service requirement reflected in that provision. The other provisions of Article 20 are still applicable. Therefore, the Agency will immediately begin accepting your requests in accordance with all of the other provisions of Article 20, consistent with the OPM minimum 90 day service requirement.

    Subject: Change in ALJ Reassignment Contract Provisions

    To All Administrative Law Judges:

    I want you all to know that effective immediately, the provisions in Article 20 Section 2 C that limit the eligibility of an ALJ to participate in the non-reimbursable reassignment provisions of the National Agreement will no longer apply. The only limitation for eligibility will be the 90-day limitation imposed by OPM. Procedures for implementing this change will be provided shortly.

NOTICE TO BARGAINING UNIT MEMBERS:

AALJ again reminds all bargaining unit members that any judge seeking a transfer must follow the procedures set forth in Article 20 of the Collective Bargaining Agreement (Master Contract). Prior requests for transfer (submitted before our contract effectuation in 2001) did not roll over for inclusion in the current reassignment register: A new request, limited to three hearing offices, must be submitted. Submissions must be via the U.S. Postal Service. Written requests are to be mailed to the Office of the Chief Administrative Law Judge with copies to the gaining and losing RCALJs. Postmarks determine the date of entry on the reassignment register.

If ALJs have submitted a request for transfer since contract effectuation by means other than U.S. mail (Fax, E-mail) they must follow up with a mailed version of the request. AALJ has received reports of e-mailed transfer requests. Please read and follow the requirements of Article 20 before mailing a request for transfer.

To help us monitor the reassignment process, please send a copy of any transfer request to your Regional AALJ Vice-President.
